This website is provided by BQSAC Foundation and its affiliates, collectively referred to as “BQSAC.” By accessing this website (referred to as the “Site”), you are confirming your acknowledgment and acceptance of these Terms of Use (“TOU”). Please read these Terms of Use carefully before using the Site or creating an account. Your use of the Site signifies that you have read, understood, and agreed to be bound by these terms, conditions, and guidelines, as we may modify them from time to time by posting revised TOUs on the Site. Be sure to check these TOUs regularly for any updates.

Violations

BQSAC may monitor the use of this Site at any time to ensure compliance with these TOU. If we determine that you have violated these terms, the spirit of these terms, or any applicable laws, we reserve the right to take various actions, including terminating or suspending your access to the Site and related services, initiating investigations, removing materials from our servers, issuing warnings, blocking prohibited activities, and taking other appropriate measures. Users who breach these TOU may also face criminal and/or civil liability.

User Responsibilities and Restrictions on Use

You must provide accurate and complete billing and registration information on the Site. Supplying inaccurate or incomplete information is considered a material breach of these TOU.

You agree to use the Site and its related services only for lawful purposes and to prevent others from using your account for unlawful activities. Any use of the Site in violation of these TOU or any applicable laws, regulations, ordinances, or governmental rules is strictly prohibited.

Specifically, you may not:

Link to this Site, including linking to the home page or any other page on the Site, without our express permission.

Engage in any activity that disrupts a user’s access to the Site or its proper operation. Additionally, you must not impersonate any person or entity while using this Site.

Privacy

Our use of your personal information collected on the Site is governed by the terms outlined in the BQSAC Privacy Policy. This policy defines our obligations concerning user data and privacy.

Intellectual Property

The distinctive “look and feel” of this Site, as well as various BQSAC emblems, logos, trademarks, and brand indicators found on the Site, are the exclusive property of BQSAC Foundation and cannot be used without express written permission. All other trademarks appearing on this Site belong to their respective owners.

Furthermore, BQSAC Foundation and/or its licensors own all rights, titles, and interests in the Content available through this Site and any other website owned, operated, or controlled by BQSAC. The Content includes text, music, sounds, photographs, videos, images, illustrations, icons, graphics, headers, typefaces, data, inventory information, databases, and software. This Content is protected by United States and international law. Your use of the Site does not transfer any right, title, or ownership interest in the Content to you. You may access and view the Content for personal, noncommercial purposes only.

Except as expressly permitted, you may not copy, distribute, display, publicly perform, transmit, or create derivative works or compilations from the Content without prior written consent from BQSAC. You are also prohibited from collecting, repurposing, reusing data or product listings contained in the Content, selling, or attempting to sell the Content, exploiting the Content for personal gain, or making derivative use of the Site or its Content.

You may download, print, and use pages from the Site for your personal, non-commercial informational purposes, provided you do not distribute or republish this information in any form and maintain the BQSAC copyright notice: “© 2024 BQSAC Foundation. All Rights Reserved.” BQSAC may seek legal remedies if you use the Content for purposes other than personal, non-commercial use.

Request for Consent to Use Content

If you wish to use the Content for any purpose beyond individual review and individual educational purposes, please submit a request with your intended use to Admin@Scouting.org for evaluation.

BQSAC is not obligated to grant such requests unless required by law and may approve or deny them at its discretion. Any approved request will be limited to a specific, enumerated use and subject to additional terms and conditions based on your intended use of the Content. Written consent from a duly authorized representative of BQSAC is required for any approval. BQSAC reserves the right to revoke its consent at any time.

If your request is granted, you assume all risks regarding the suitability and accuracy of the Content you use. Some uses may require third-party permissions, and you are responsible for obtaining these permissions and paying any necessary royalties.

Amendments and Corrections to Content

The Content and the Site’s functionality may be updated or changed without prior notice. We do not guarantee the accuracy, completeness, or reliability of information on the Site. The Site may contain errors and omissions related to BQSAC’s programs, events, products, pricing, and availability. We reserve the right to correct or update errors or omissions and change information at our discretion without prior notice. You agree not to rely on any Content created or posted by us. We also reserve the right to cancel an order for a product in the event of an error or omission in the product description.

By using the Site, you agree to hold us harmless from any claims related to errors or omissions on our Site.

Indemnity

You agree to indemnify, defend, and hold us, our local councils, partners, telecommunications providers, service providers, and their officers, directors, employees, and agents, harmless from any cause of action, damages, judgments, liabilities, fees, or other costs and expenses arising from a third-party claim related to your use of the Site or any related services, your use of any Content, your violation of these TOU, or your violation of any third-party rights, including infringement of trademark, copyright, patent, publicity, privacy, or other rights.

Limitation of Liability

We, our suppliers, service providers, local councils, or other third parties affiliated with us will not be liable for indirect, incidental, extraordinary, exemplary, punitive, or consequential damages (including those resulting from lost profits, lost data, or business interruption) arising from your use or inability to use the Site or related services, the results of such services, or any information contained on the Site. Our aggregate liability, as well as that of our suppliers, local councils, or service providers, is limited to one hundred U.S. dollars ($100) concerning this TOU. Applicable law may not allow the exclusion or limitation of incidental or consequential damages, so this limitation may not apply to you.

Disclaimer of Warranties

This Site and all related services are provided “as-is” and “as available,” and the entire risk as to satisfactory quality, performance, accuracy, and effort is with you. Except for the express warranties explicitly provided herein, neither we nor our partners, providers, or local councils make any representations or warranties of any kind, express or implied, as to the operation of the Site, the Content, information made available through the Site, or any transactions entered into by you through the Site. To the extent permitted by law, we and our partners, providers, and local councils disclaim all warranties, express or implied, including but not limited to, implied warranties of merchantability, accuracy, title, fitness for a particular purpose, non-infringement, and quiet enjoyment. Neither we nor our partners, providers, or local councils warrant that the Site and related services will be uninterrupted, available at any time or location, secure, error-free, free of viruses, or free of other harmful components. Neither we nor our partners, providers, or local councils warrant that the Site will meet your requirements or that any defects will be corrected. You understand and agree that your access and use of the Site are at your own risk.

Modifications

Please note that we may change these TOU at any time by posting the modified TOU on the Site or by notifying you of such changes. Using the Site after these changes are posted constitutes acceptance of all changes.

Applicable Law

These TOU are governed by and will be construed in accordance with the laws of the state of Washington DC as applied to contracts entered into by residents of the state of Washington DC.

Disputes

Any dispute related to your visit to this Site or any other website owned, operated, or controlled by BQSAC, or products you purchase through this Site, will be subject to confidential arbitration in Washington DC. However, if you have violated or threatened to violate BQSAC Foundation’s intellectual property rights, we may seek injunctive or other appropriate relief in any state or federal court in Washington DC, and you consent to exclusive jurisdiction and venue in such courts. Arbitration under this TOU will be conducted by a single arbitrator under the rules prevailing under the Commercial Arbitration Rules of the American Arbitration Association. The arbitrator’s award will be binding and may be entered as a judgment in any court of competent jurisdiction. No arbitration under this Agreement will be joined to an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise.

Policy for Claims of Infringement of Copyrighted Material

If you believe that material is posted on the Site in a manner that infringes your copyright, please notify us by providing the following information in writing to our Legal Department at the address listed below:

A physical or electronic signature of the owner of the allegedly infringed copyright or such owner’s authorized representative.

A description of the copyrighted work claimed to have been infringed or, if multiple copyrighted works are at issue, a list of such works.

A description of the material on the BQSAC site that is claimed to be infringing or to be the subject of infringing activity, and information reasonably sufficient to permit us to locate the material.

The address, telephone number, and, if available, an electronic mail address at which you may be contacted.

A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.

A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of the copyright that is allegedly infringed.
